ANNAPOLIS, Md. (AP) -
The Environmental Protection Agency says it plans to deny Maryland and Delaware petitions seeking emissions reductions from power plants in five upwind states.

The federal agency said Friday that it has concluded neither Delaware nor Maryland has met their burden to show the power plants they cite emit pollution at levels that violate the Clean Air Act's good neighbor provision. The upwind states are Indiana, Kentucky, Ohio, Pennsylvania and West Virginia.

The EPA says it will accept comment on the proposed action for 45 days, and a public hearing will be held in Washington.

Maryland Attorney General Brian Frosh says it's clear and undeniable the emissions pollute Maryland air and violate the law. He says his office will consider all options to protect the state over the next few weeks.
