8/10/2017 - Lassen County Board of Supervisors Hear Appeal For Non-Compliant Building

During the Lassen County Board of Supervisors meeting, the Board was asked to hear an appeal represented by Everd McCain of the Lassen County Planning Commission non-action regarding a design from Danny Leung.
The applicant, Mr. Leung, is proposing to bring into compliance an existing (unapproved/unpermitted) 1,080 square foot garage built within the last year.
The proposed project currently does not meet the height requirements of Lassen County Code, however, deviation from these requirements may be allowed through the Design review process.
Frustration surrounds the issue from both the applicant and the Building Department, with disagreements on each side.
Issues stem from the belief that the applicant built the structure while knowingly and willfully circumventing the building approval process.
The applicant had previously sought direction from the building department, but never received a permit or approval prior to erecting the structure.
The Boards decision was therefore difficult as their options were to approve or deny the appeal.
Approving the appeal would possibly condone such circumvention of Lassen County Code and the Building permit process.
However, denial would disapprove the design repeal and put the building at risk for abatement.
The Board discussed the matter at length, however, the final decision was to table the matter until next meeting in a 4-1 vote with Supervisor Albaugh voting no.
